Unusually heavy snowfall over the weekend kept Aurora’s streets division working around the clock to keep roads clear.
Saturday’s winter storm dumped six to nearly nine inches of snow on the Aurora area, according to National Weather Service meteorologist Kevin Doom. That amount of snowfall often happens every or every-other winter season, but not usually this early in the season, he said.
The snow came from a “really strong, quickly-evolving storm system” that came through the Midwest, right through “the heart of Chicagoland,” Doom told The Beacon-News. The storm system was “loaded with moisture,” he said, and was on the right track to dump all this snow over the area.
“We were sort of ground zero for the highest snow, here and southern Wisconsin,” Doom said.
The snowfall broke records in Chicago as the 8.4 inches recorded to have fallen at O’Hare International Airport on Saturday is the largest amount ever on a single calendar day in the city in November.
And the storm dumped the most snow Aurora has seen fall over such a short period of time in six or seven years, city Superintendent of Streets Adrian Perez said.
“Historically, it’s been pretty light,” he said. “We really haven’t seen this much snowfall in quite some time.”
Considering the city’s streets division is relatively “green,” with a lot of turnover and veterans retiring, staff did a “fantastic job” clearing the city’s roads over the weekend, according to Perez. Although it might have taken a little bit longer than expected, he said, the division hit its goal of getting done on Sunday.
Streets division staff worked mandatory 12-hour shifts over the weekend, with work starting at 3 a.m. on Saturday and finishing at around 5 p.m. on Sunday, Perez said. Other city divisions within the Public Works Department also helped out, he said.
“Every person that we had available was running routes,” Perez said.
Throughout the snowfall, staff worked to make sure primary roads stayed as clear as possible, especially heading into Sunday morning, according to Perez. And even before the snow started to fall, he said, workers were out salting those primary roadways to prepare.
Another snow-removal service offered by the city of Aurora, which shovels the walkways and driveways of seniors and those with disabilities, also sprung into action because of the winter storm over the weekend. Aurora Senior and Disability Services Manager Katrina Boatright said 230 homes were serviced by 50 “Snow Angel” volunteers and two contractors through the “Operation Senior Shovel” program.
The storm didn’t impact the Fox Valley Park District’s programming, and its facilities are operating under regular hours, per a district spokesperson. Preparation for the snowstorm started as early as Wednesday, with efforts focused around its four community centers — the Vaughan Athletic Center, Prisco and Eola community centers, and the Copley Boxing and Training Center — plus the Cole Center Administrative Office.
“Our top priority is always the safety of our residents,” Melissa Harrison, assistant director of park operations, said in a statement. “When winter weather approaches, our crews move quickly to treat surfaces and clear our community centers first, ensuring the places people rely on most remain safe, accessible and ready to serve.”
The park district’s snow removal crews worked staggered shifts from 4 a.m. to 10 p.m. on Saturday and Sunday, a district spokesperson said. Monday was spent clearing other sites and preparing for more forecasted snow.
It was also snowing on Monday afternoon, which the National Weather Service forecasted would be about one to three inches in total. Some snow showers are also forecast for Wednesday, which will come along a cold front, according to a post on the National Weather Service Chicago’s Facebook page.
Doom told the Chicago Tribune that the area might see a bit more snow this winter than in recent years, but that a single snow like the one Saturday does not necessarily mean more snow this season. Last year, the Chicago area saw just 17.6 inches of snow, less than the typically-expected 38.4 inches, the Tribune has reported.

Ecuador: Sancionan a liga y federación por mal manejo de datos personales
QUITO (AP) — La Federación Ecuatoriana de fútbol y la Liga Profesional del país sudamericano fueron sancionadas el lunes con multas que en conjunto suman alrededor de 455.000 dólares debido a lo que las autoridades consideraron infracciones graves en el tratamiento de datos personales al registrarse para seguir las páginas online de ambas entidades.
La Superintendencia de Protección de Datos Personales señaló que se confirmó “la existencia de una infracción grave” debido a la falta de medidas administrativas, técnicas, físicas, organizativas y jurídicas “suficientes para garantizar un tratamiento adecuado de datos personales” mediante el uso de las aplicaciones Fan ID y Fan FEF.
La Liga Profesional fue notificada con una multa de 259.644 dólares y la disposición de informar a 14.398 personas “cuyo consentimiento no fue obtenido de forma válida” y además eliminar los datos personales recabados con el Fan ID.
Por su parte, la federación recibió una multa de 194.856 dólares, además la orden de poner en marcha una política de protección de datos, informar a los titulares sobre la invalidación del consentimiento obtenido y eliminar los datos tratados a través del Fan FEF.
La superintendencia destacó que estas decisiones marcan un precedente importante y envío “un mensaje directo para todos los responsables del tratamiento de datos”.
Las dos entidades sancionadas aún no han emitido comentarios.
La sanción se produce días antes del sorteo del Mundial de 2026 en Estados Unidos, Canadá y México, el primero de la historia con 48 participantes, uno de ellos Ecuador, país que asiste a su quinto mundial.

Did A German Court Just Shatter One Of The Biden Era’s Biggest Lies
Below is my column in The Hill on the latest development in the investigation of the environmental crimes committed in the sabotage of the Nord Stream pipelines in the waters near Denmark and Sweden in 2022. The German court issued an arrest warrant for a Ukrainian in a move that could prove an embarrassment for not just Volodymyr Zelensky but Joe Biden. The truth is still unknown with allegations against both Russia and Ukraine. There are “false flags” flying on both sides that dismiss clues pointing to one country or the other. However, the Germans appear to be zeroing in on key Ukrainian figures.
It is often said that “the first casualty when war comes is truth.” A criminal warrant just issued in Germany shows that war continues to claim its victims. However, this warrant could prove to be as great an indictment not just of the government of Volodymyr Zelensky, but also of former President Joe Biden.
This week, a German court issued an arrest warrant for Ukrainian Serhii Kuznietsov, which may finally confirm what was long suspected: that Ukraine was responsible for the 2022 sabotage of the Nord Stream pipelines in the waters near Denmark and Sweden.
The Biden administration may have been given prior warning. It was allegedly told years ago by a Ukrainian whistleblower that a six-person team of Ukrainian special forces was planning to rent a boat, dive to the sea floor and blow up the Nord Stream project. The operation was reportedly led by Gen. Valerii Zaluzhnyi, commander-in-chief of Ukraine’s armed forces.
Nevertheless, after the attack, the Biden administration and many in the media fueled speculation that Russia had destroyed its own pipeline, despite evidence and logic to the contrary.
It was another convenient claim of a Russian false-flag operation that allowed the Biden administration to ignore the possibility that Ukraine had not only engaged in environmental crimes but had also knowingly lied to its allies.
For years, some of us have questioned the official account from the Biden administration about the available evidence of those responsible.
The suggestion of a Russian attack on a Russian pipeline never seemed logical.
However, the administration was funneling billions in support for Ukraine, funding that now exceeds an estimated $180 billion.
Having Ukraine sabotage pipelines to our allies would hardly be opportune when many were questioning the costs to U.S. citizens.
The Biden administration was not alone in running interference for Ukraine, as Zelensky denied responsibility despite mounting evidence to the contrary. When another alleged Ukrainian saboteur was found in Poland, a Polish court blocked the extradition to Germany and ordered his release. The reason? The judge did not base the decision on Ukrainian denials. Instead, he declared that the act had been committed in the name of a just war. (Poland remains the frontline against Russian aggression in Europe).
An Italian court did not engage in such rationalization. It ordered the extradition of Kuznietsov, believed to be a key figure in the conspiracy. The attack involved leasing a yacht in the German port of Rostock, using forged IDs and a screen of intermediaries. Kuznietsov insists that he was an army captain serving in Ukraine at the time.
If the investigators are correct, it was not just the Ukrainian government that was lying to us. Biden was also presumably informed by the intelligence agencies of this evidence. Yet Biden kept suggesting anyway that the Russians were covering up the truth. He told the public, “The Russians are pumping out disinformation and lies. We will work with our allies to get to the bottom [of precisely what happened] Just don’t listen to what Putin’s saying. What he’s saying we know is not true.”
Ironically, even if we were told about this evidence, the public might still have supported the commitment to Ukraine. After all, Ukraine is the victim of a horrendous invasion that has involved repeated charges of war crimes against the Russian forces. However, the public has a legitimate expectation that a country that is receiving billions in support will not engage in environmental attacks on our allies. These pipelines were in the economic zone of two NATO countries.
As the Germans work to find the truth, the question is whether the American public will ever be given transparency on our own government’s alleged complicity or knowledge. The public was asked to pump billions into a war while the administration allegedly covered up an attack by Ukraine on a Western pipeline — and then may have misled the public.
The public also has a right to know if the CIA was told in advance that this attack was coming and either gave tacit approval or said nothing to our allies.
While Johnson is often quoted on his 1929 line about truth in war, the line following was equally poignant: “this mode of propaganda whereby … people become war hungry in their patriotism and are lied into a desire to fight. We have seen it in the past; it will happen again in the future.”
It may have happened in the U.S., and truth was not the only casualty. The American people were treated as chumps who could not handle the truth.

Long-awaited New Lenox roundabout running smoothly, mayor says
For at least a decade, New Lenox officials have grappled with a busy, curvy three-way intersection where North Cedar Road and South Cedar Road meet East Haven Avenue.
But since a roundabout opened in early October, Mayor Tim Baldermann said the intersection has run more smoothly, despite some resident concerns that confusion on how to use the roundabout could be unsafe.
Baldermann, along with police Deputy Chief Tim Perry, said there have been no accidents or safety issues at the roundabout. Baldermann said he rarely sees backed-up traffic there anymore.
Residents previously said roads around the intersection were almost always backed up, drivers often got confused and didn’t know where to stop or go and some residents started avoiding the intersection altogether.
Baldermann said there has been some negative feedback that the roundabout occasionally gets backed up when an outbound train traveling from Chicago stops and shuts down Cedar Road, just north of Route 30.
He said it takes time for the train to stop and drop people off, which clogs up several roads, but he said even then there is less backup with the roundabout than under the three-way intersection.
He said he has received comments from residents that some drivers still don’t understand navigating the roundabout and try to yield to the incoming cars as they drive around the circle.
“People have to remember to keep moving once you’re in a circle,” Baldermann said. “You don’t stop.”
But overall, Baldermann said the interest in the roundabout has died down. He said in October he was fascinated by residents’ interest and involvement in the project.
“Now that they see it, it’s really no big deal,” Baldermann said. “Now we’ll be onto the text topic, whatever that may be.”

A roundabout was first recommended in 2018 by a New Lenox traffic study. Then Village Administrator Kurt Carroll said a roundabout would be the safest option and the village would seek grant money for a roundabout, that could potentially pay for 80% of the cost.
Baldermann said Monday the village accomplished this promise and said 80% of the funding came from federal and state grants, which he said saved several million dollars.
The project was originally approved for $2.7 million, but that that number increased to $4 million when the village had to purchase nearby properties for the project, Baldermann said.
Baldermann also said the roundabout can help the village manage its growing population, along with other road improvements such as an extra lane on Cedar Road and improvements on Nelson Road.
Traffic was projected to increase from 12,300 cars traveling through the intersection per day in 2023 to about 18,000 cars in 2050, according to the village in 2023. Officials also said accidents and issues with pedestrians occur at the intersection.
“We’re constantly trying to stay ahead of that growth with the infrastructure improvements,” Baldermann said.
Baldermann said landscaping work for the middle of the roundabout will finish in spring 2026 and include grass, a New Lenox sign that reads “home of proud Americans,” a water component and flag poles.

Naperville’s new public works director starts this week
Daniel Randolph assumed his new job Monday as the city of Naperville’s new director of public works.
Randolph has more than 20 years of civil engineering and public works management experience, most recently working as the assistant director of engineering and public works in Schaumburg, according to a city news release.
In Schaumburg, he helped develop the department’s strategic plan, oversaw a $45 million operating budget and managed several large-scale capital improvement projects, including the design, demolition and construction of the Schaumburg Village Hall.
He has also served as a civil engineer for Niles and assistant engineer for Mount Prospect. In those positions, he was involved with various streetscape, street resurfacing, and sewer and water main improvement initiatives, the release said.
Randolph has master’s degrees in public administration and civil engineering.
American Legion Post 43 announces new $500 scholarships
American Legion Post 43 Naperville is launching six new $500 scholarships for student veterans, reservists and members of the National Guard who attend North Central College, Benedictine University or College of DuPage.
Applications will open in February.
The initiative supports military personnel who are transitioning to civilian life through education and helps strengthen ties within the Naperville community, according to a Post 43 news release. It complements the four $3,000 scholarships the post gives annually to local high school seniors.

The Forest Preserve District of Will County is encouraging residents to get active this month by participating in a virtual 5K for a chance to win a commemorative shirt.
December Dash will take place all month, giving participants a chance to enjoy the forest preserves this winter. After downloading a running app to track distances, participants can run, jog or walk a 3.1-mile route on one of 10 designated trails.
Eligible trails include the DuPage River Trail, Hickory Creek Bikeway, Lake Renwick Bikeway, Messenger Woods Nature Preserve Trail, Old Plank Road Trail, Plum Creek Greenway Trail, Prairie Bluff Trail, Rock Run Greenway Trail, Spring Creek Greenway Trail and Wauponsee Glacial Trail. Locations are available on the district’s website, www.reconnectwithnature.org.
The first 100 participants to submit their route on the district’s website will receive a commemorative long-sleeve shirt, officials said. Shirts, which are sky blue and feautre a snowy trail graphic, will be available for pickup in January, the district said.

DuPage Care Center among the best: U.S. News ranking
The DuPage Care Center, which provides long-term care and short-term rehabilitative services for DuPage County residents, was ranked among the best nursing homes in the nation by U.S. News and World Report.
Nearly 15,000 nursing homes were evaluated as part of the rankings process, with the Wheaton-based center reviewed for both long- and short-term care, a news release said.
Fewer than 19% of the facilities considered were named “Best Nursing Homes,” which is reserved for facilities that satisfy criteria demonstrating a commitment to quality patient and resident care, the release said.
The 366-bed skilled nursing and rehabilitation facility has been serving county residents for more than 130 years.
In 2023, the county launched a $31.5 million project, expected to be completed next summer, under which resident rooms, the main entrance and lobby, common areas and nursing stations are to be renovated.

‘We have a Hallmark town’: Holiday events showcase Grayslake
Grayslake was able to get its major holiday event done in one day before Lake County was hit with a significant snowstorm over the weekend.
The Ferris wheel was back this year and more popular than ever at the Festival of Lights and Holiday Market on Friday in downtown Grayslake. It provided a festive backdrop to the parade, which started by rounding the corner onto Center Street.
Christopher and Holly Rusch of Gurnee brought their children Luka, 2, Maxwell, 4, and Hudson, 8.
“They were so excited,” Holly Rusch said. “They wanted to come see Santa. We weren’t expecting the Ferris wheel to be here, and they were so pumped.”
The complimentary festival included photos with Santa at the Heritage Center, the post sunset parade with high school marching band musicians, the tree lighting immediately following the parade, holiday caroling by Central and North Grayslake high school choral members, art exhibits and giving tree displays, plus business and charitable fundraising organizations staffing outside booths and tents.
The Festival of Lights and Holiday Market was hosted by the Grayslake Area Chamber of Commerce and showcased the Grayslake Village Center.

“This is an event the chamber does for the community, Village Center coordinator Allison Koch said. “They do a lot to put this on. We are really excited for this.

People lined the parade route wearing blankets to keep warm and donned festive holiday hats that lit up. Holiday bulb necklaces were seen twinkling, and children waved illuminated toys, perhaps bought from vendor carts.
Santa and Mrs. Claus arrived in a parade that launched while the skies were still tinted with post-sunset color. The couple was escorted to the stage, where Grayslake Mayor Elizabeth Davies awaited to help with the grand countdown to light the evergreen with white lights.
“We always believe in Grayslake that we have a Hallmark town, and this is one of those moments that makes it so,” Davies said. “Wonderful people come out and support us here in Grayslake.

WASHINGTON (AP) — La Casa Blanca dijo el lunes que un almirante de la Marina actuó “dentro de su autoridad y de la ley” cuando ordenó un segundo ataque contra una lancha en el mar Caribe que supuestamente llevaba drogas, como parte de una operación militar de Estados Unidos en septiembre que ha sido objeto de escrutinio de los dos principales partidos políticos del país.
La secretaria de prensa de la Casa Blanca, Karoline Leavitt, expuso los motivos para el ataque del 2 de septiembre después de que legisladores de ambos partidos anunciaran el domingo que apoyaban que el Congreso revisara los ataques militares de Estados Unidos contra embarcaciones sospechosas de contrabando de drogas en el mar Caribe y el océano Pacífico, citando un reporte de prensa acerca de que el secretario de Defensa, Pete Hegseth, emitió una orden verbal para un segundo ataque que mató a los sobrevivientes del primer ataque contra la lancha en ese incidente.
En sus comentarios a los periodistas el lunes, Leavitt no disputó el reporte del Washington Post que indicaba que había sobrevivientes después del ataque inicial por parte del ejército de Estados Unidos. Su explicación vino después de que el presidente Donald Trump dijera un día antes que “no habría querido eso, no un segundo ataque” cuando se le preguntó sobre el incidente.
“El secretario Hegseth autorizó al almirante Bradley llevar a cabo estos ataques cinéticos”, señaló Leavitt, refiriéndose al vicealmirante de la Marina de Estados Unidos Frank Bradley, quien en ese momento era el comandante del Comando de Operaciones Especiales Conjuntas. “El almirante Bradley actuó bien dentro de su autoridad y la ley al ordenar la ofensiva para asegurarse de que el bote fuera destruido y la amenaza a los Estados Unidos de América fuera eliminada”.
Los legisladores dijeron que no sabían si el reporte del Post de la semana pasada era cierto, y algunos republicanos eran escépticos. Aun así, dijeron que los reportes de atacar a sobrevivientes de un ataque inicial con misiles planteaban serias cuestiones legales y merecían un mayor escrutinio.
“Esto alcanza el nivel de un crimen de guerra si es cierto”, dijo el senador demócrata Tim Kaine.
Cuando se le preguntó sobre un segundo ataque contra personas que ya no podían luchar, el representante republicano Mike Turner dijo que el Congreso no tiene información de que eso haya ocurrido. Señaló que los líderes de la Comisión de Servicios Armados tanto en la Cámara de Representantes como en el Senado han abierto investigaciones.
“Obviamente, si eso ocurrió, sería muy serio y estoy de acuerdo en que sería un acto ilegal”, aseveró Turner.
Trump defendió ardorosamente a Hegseth el domingo.
“Pete dijo que no ordenó la muerte de esos dos hombres”, comentó Trump “Y yo le creo”.
Leavitt señaló que Hegseth ha hablado con miembros del Congreso que pueden haber expresado algunas preocupaciones sobre los reportes de prensa.
Después del informe del Post, Hegseth escribió el viernes en X que “las noticias falsas están entregando más reportajes fabricados, inflamatorios y despectivos para desacreditar a nuestros increíbles guerreros que luchan para proteger la patria”.
“Nuestras operaciones actuales en el Caribe son legales tanto bajo la ley de Estados Unidos como la ley internacional, y todas las acciones cumplen con la ley de conflicto armado, y han sido aprobadas por los mejores abogados militares y civiles, a lo largo de la cadena de mando”, alegó Hegseth.
Leavitt también confirmó que Trump sostendría el lunes una reunión con su equipo de seguridad nacional para discutir las operaciones en curso en el mar Caribe y posibles próximos pasos contra Venezuela.
El gobierno de Estados Unidos dice que sus ataques militares en el Caribe están dirigidos contra los cárteles de drogas, algunos de los cuales afirma están controlados por el presidente venezolano Nicolás Maduro. Trump también está considerando si llevar a cabo ataques en el territorio continental de Venezuela.
Trump confirmó el domingo que había hablado recientemente por teléfono con Maduro, pero se negó a detallar la conversación.
Los ataques del ejército estadounidense contra pequeños botes en el mar Caribe y el océano Pacífico, que según Estados Unidos se usaban para el contrabando de narcóticos, han matado a más de 80 personas.
La Asamblea Nacional de Venezuela anunció el domingo una investigación sobre los letales ataques llevados a cabo por Estados Unidos.
El anuncio por parte del presidente de la Asamblea, Jorge Rodríguez, marcó la primera vez que un funcionario del gobierno de Maduro reconoce explícitamente que ciudadanos venezolanos han sido asesinados por la operación militar de Estados Unidos que comenzó hace unos meses.
Rodríguez dijo que un grupo de legisladores se reunirá para investigar “los graves hechos que condujeron al asesinato de venezolanos en aguas del mar Caribe”.

Dua Lipa invita a comer unos tacos en México

CIUDAD DE MÉXICO (AP) — La serie de conciertos de Dua Lipa en México viene acompañada de una taquería con todo y salsa picante.
La cantante abrió el lunes La Dua, una taquería temporal en donde los fans registrados pueden comerse unos tacos en honor a la cantante británica pop.
Lipa es afecta a viajar a México y disfrutar de su gastronomía, por lo que no pareció extraño a sus seguidores que, en el marco de los tres conciertos que ofrecerá esta semana en el Estadio GNP Seguros, surgiera esta taquería.
El menú de La Dua incluye un Taco Houdini de chicharrón, un Taco Maria de arrachera y un Taco Radical Optimism de “caramelo” o barbacoa de res con queso. También tiene consomé y Agua Training Season de pepino con limón, cerveza o una margarita de tequila con limón. El menú tiene un costo de 249 pesos (13,6 dólares).
Cada día se esperan cerca de 800 comensales. Gerson Silis hizo su registro el viernes por la tarde para ser uno de los primeros.
“Dua Lipa es mi cantante favorita, entonces tener ese tipo de experiencias es muy bueno para todos nosotros lo que somos fans, me encanta”, dijo Silis, quien es un vendedor de 26 años. Silis se preparaba para ir al segundo concierto de Lipa, el martes.
La diseñadora industrial Alejandra Avilés, de 28 años, y su amiga Génesis Aguirre, diseñadora gráfica, de 29, viajaron desde Mazatlán para asistir al concierto del lunes.
Dua Lipa tiene una sección de covers en su gira Radical Optimism que ha incluido a Soda Stereo y Shakira en Argentina y Colombia, respectivamente. Avilés y Aguirre dijeron que les gustaría que cantara algo de las artistas mexicanas Julieta Venegas o de Natalia Lafourcade.
Su taco favorito fue el Maria de arrachera.
Incluida en el menú había una bolsa de regalo con servilletas, un gorro de taquero y un calendario 2026 con una fotografía de Dua Lipa, similar a los calendarios que se pueden ver en las taquerías de México.
Fernanda Reyes, de 23 años, estudiante de administración de empresas, dijo que su taco favorito fue el Radical Optimism. Ella iba a ir al concierto del lunes.
“La amo reina, devoró, o sea ¡guau!”, dijo sobre Lipa. “Lo voy a enmarcar, en mi cuarto”, agregó mirando su calendario.
De acuerdo con datos del Instituto Nacional de Estadística y Geografía (INEGI) el 70% de la población mexicana considera a los tacos como su comida favorita y más del 90% los consume al menos una vez por semana. La Ciudad de México tiene más de 10.900 taquerías, según el INEGI. En la aplicación UBER en se hicieron 8 millones de pedidos de tacos en la ciudad en 2024.
El local donde está La Dua es regularmente una taquería llamada Tacos Los Caramelos y buena parte de su personal estaba atendiendo a los fans para el proyecto especial de la cantante.
“Súper bueno, de la mejor calidad”, dijo Javier Morales, capitán de meseros de 33 años, quien trabaja en Los Caramelos. “Vienes a disfrutar un rato, la intención es que te sientas cobijada por nosotros, que vengas por tu taco, que puedas vivir como esa experiencia y pues lo comas”.

Appeals Court Rules Alina Habba Unlawfully Serving As US Attorney For New Jersey
In the latest legal blow to the Trump administration, a federal appeals court on Monday ruled that Alina Habba is unlawfully serving as New Jersey’s top prosecutor.
A three-judge panel for the US Court of Appeals for the 3rd Circuit said in a unanimous order that a lower court correctly disqualified Habba, who previously served as Trump’s personal defense lawyer. In that ruling, US District Judge Matthew Brann (Obama) said that Habba had been serving without lawful authority since the beginning of July, when she was tapped to temporarily lead the US Attorney’s Office in New Jersey. Brann also disqualified her from participating in ongoing cases.
Ahead of the 120-day deadline, the judges in New Jersey declined to allow Habba to continue serving as U.S. attorney and instead voted to install her deputy, Desiree Leigh Grace, to the position. But that decision was met with swift pushback from Attorney General Pam Bondi, who fired Grace.
Then, Mr. Trump and top administration officials employed a multi-step maneuver to keep Habba in the role of U.S. attorney and get around the district court’s decision. First, the president withdrew Habba’s nomination for U.S. attorney in New Jersey. Then, Habba resigned as interim U.S. attorney. Bondi then appointed Habba as “special attorney” and to fill Grace’s role as first assistant U.S. attorney. Finally, because the position as the New Jersey’s top prosecutor was vacant, Habba was elevated to the role of acting U.S. attorney under the Federal Vacancies Reform Act. –CBS News
The appeals court agreed with Brann, writing in their decision that the administration’s argument would “effectively [permit] anyone to fill the U.S. Attorney role indefinitely,” adding “this should raise a red flag” since Habba’s appointment to the role was limited to 120 days unless the district court in New Jersey voted to extend her tenure, or if she was confirmed to the post by the Senate.
“Under the Government’s delegation theory, Habba may avoid the gauntlet of presidential appointment and Senate confirmation and serve as the de facto U.S. Attorney indefinitely,” Judge Michael Fisher wrote for the court. “This view is so broad that it bypasses the constitutional [presidential appointment and Senate confirmation] process entirely. It also essentially eliminates the requirements of the FVRA and the U.S. Attorney-specific statute.”
During a hearing in October, the judges grilled a DOJ lawyer over the unconventional way Habba was reinstated after her initial temporary appointment expired.
The Habba decision comes on the heels of a federal judge who ordered the criminal charges against former FBI DIrector James Comey and New York AG Letitia James dismissed on the grounds that interim US attorney Lindsey Halligan was similarly unlawfully appointed to the role.
The administration can now ask for a full panel of 3rd Circuit judges to reconsider the decision, or it can bring the case to the Supreme Court.
